IHS Waives Buy American Requirements for Recovery Act Sanitation Facilities Construction Projects

On June 15, the Indian Health Service published in the Federal Register a notice granting a nationwide limited waiver of the Recovery Act’s Buy American requirements in Section 1605 for de minimis incidental components of sanitation facilities construction projects funded by the Recovery Act. The Federal Register notice is available here:

This waiver permits the use of non-domestic iron, steel, and manufactured goods when they occur in de minimis incidental components (which means that cumulatively comprise no more than a total of five percent of the total of the materials used in the project), of projects funded by the Recovery Act that may otherwise be prohibited.
