Federally recognized Tribes. Funding via Tribal Set-aside, and distributed via a regional allocation formula.
Program Description:
The Safe Drinking Water Act (SDWA) authorizes EPA to set aside a portion of each year’s appropriation and use it to make direct grants for capital improvements to improve the infrastructure of drinking water systems that serve Indian Tribes. Some examples are projects to: rehabilitate or develop sources of drinking water; install or upgrade treatment facilities; install or upgrade storage facilities; install or replace transmission or distribution pipes; and replace aging water system infrastructure. Funds can also be used to conduct project feasibility studies, engineering design work, and project administration.
EPA’s Office of Ground Water and Drinking Water (OGWDW) distributes set-aside funds via an allotment formula among the nine EPA Regions with Tribal programs in consultation with the Indian Health Service (IHS) and the Tribes in their Region. EPA Regions identify and prioritize projects, and many rely primarily on IHS’s Sanitation Deficiency Systems (SDS) list.

To seek Stimulus funding for projects not currently on the SDS list, tribes should contact their EPA and IHS regional contacts as soon as possible.

General Provisions:
Under the Stimulus, EPA will reallocate funds appropriated where projects are not under contract or construction within 12 months of the date of enactment of the Act. Up to 4 percent of the funds appropriated for tribal set-aside may be transferred to IHS for support management and oversight of tribal project.
